JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bhagwanpur PS Case No. 139 of 2017 registered under Sections 447, 386, 387, 307/34 of the IPC and Sections 25(1-b)a, 26 and 27 of the Arms Act. The allegation in brief is that the petitioner along with one Kari Choudhary went to the shop of the informant, made demand of extortion, forcibly taken 45,000/- rupees cash and Kari Choudhary also opened firing.

Submission is that there is no allegation against the petitioner of firing which is against Kari Choudhary and the petitioner has falsely been implicated. However, the petitioner has three criminal antecedents.

Having considered the aforesaid facts and circumstances the prayer for bail of the petitioner is rejected. However the petitioner may renew his prayer for bail after one years if the trial does not conclude.

The trial court is directed to expedite the trial and conclude the same preferably within the aforesaid period. Snkumar/- (Arun Kumar, J.) U T
