The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 447, 448, 341, 323, 324, 325, 307, 504, 506/34 of the Indian Penal Code.

As per prosecution case, the informant alleged that on 24.11.2022, petitioner along with co-accuse persons came at his house and started assaulting due to property altercation. It is further alleged that co-accused, namely, Birendra Yadav tied his legs and assaulted by means of iron rod due to which his both legs were broken.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.13419 of 2023(2) dt.05-05-2023 2/2 petitioner is innocent and has committed no offence. She has falsely been implicated in this case due to previous enmity. There is no specific allegation of assaulting leveled against the petitioner rather general and omnibus allegation leveled against her. The specific allegation of assaulting is against coaccused due to which legs of the informant were broken. It is further submitted that the petitioner is languishing in judicial custody since 05.01.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as being a lady, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sarsi P.S. Case No. 277 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Purnea (Sunil Kumar Panwar, J) Manish/- U T
