JUSTICE ARUN KUMAR ORAL ORDER 01-02-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Makhdumpur (Tehta) PS Case No. 262 of 2015 registered under Sections 302 and 34 of the IPC.

The allegation in brief is that when the informant's mother denied to execute sale deed of land in favour of petitioner No. 1 it is said that they all jointly assaulted her as a result of which she succumbed to death.

Learned Counsel for the petitioners submits that petitioner No. 1 is wife of the informant and daughter-in-law of the deceased and she is a lady, there is general and omnibus allegation of assault and one of the co-accused Vijay Yadav has been admitted to bail by a coordinate Bench of this Court of this Court. Learned Counsel for the State submits that there is allegation against the petitioners.

Having considered the said facts and circumstances, the petitioners, namely, Usha Devi and Ujjawal Kumar are is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten

No.4135 of 2018 (2) dt.01-02-2018 thousand) with two sureties of the like amount each to the satisfaction of CJM Jehanabad in connection with Makhdumpur (Tehta) PS Case No. 262 of 2015 with the condition that the petitioners shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of medical emergency their bail bonds shall be liable to be cancelled.
