JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 21.01.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Excise case no. 08/2014 registered under sections 13 (f), 47 (f) of the Excise Act and 2 (c ) , 3 of the Mahua Flowers Control Act. Allegedly, in huge quantity Mahua Flowers were recovered from a house and it is stated that petitioner had taken the aforesaid house on rent.

It is not in dispute that owner of the aforesaid house is one Satyadev Singh.

The contention on behalf of the petitioner is that petitioner is not tenant of Satyadev Singh and, as a matter of fact, one Dipak Sah had taken the aforesaid house on rent which is evident from annexure 3 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.2847 of 2015 (2) dt.21-01-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Excise case no. 08/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
