The petitioner apprehends his arrest in Katihar Town P.S. Case No. 87 of 2013, registered for the offences punishable under Section 420 of the Indian Penal Code and Section 63 of the Copyright Act and under Sections 103/104 of the Trade mark Act. The sole contention of the petitioner is that he is a retailer of four and love cream not fair and lovely. There is no allegation that the petitioner manufactured any duplicate brands. During the course of investigation, the investigating officer also found that the petitioner is retailer of different brands and not the retailer of products of Proctor & Gamble Company and Hindustan Unilever Company.

Considering the facts aforesaid, the petitioner, in the

Patna High Court Cr.Misc. No.2894 of 2015 (2) dt.21-01-2015 event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 87 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
