The petitioner apprehends his arrest in Bariarpur P.S. Case No. 32 of 2014, registered for the offences punishable under Sections 153A, 295 and 427/34 of the Indian Penal Code. The case is registered against unknown.
Learned counsel for the petitioner submits that petitioner is not named in the First Information Report. One of the co-accused, namely, Md. Ejaz @ Md. Dular was apprehended and he is said to have disclosed the name of the petitioner. Having considered the fact that the petitioner was not apprehended on the spot while pelting stones on the idol of Hanuman Ji and the fact that the name of the petitioner figured in the confessional statement of the co-accused, namely, Md. Ejaz @
Patna High Court Cr.Misc. No.4031 of 2015 (2) dt.29-01-2015 2 / 2 Md. Dular, petitioner Md. Bhutto, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Bariarpur P.S. Case No. 32 of 2014, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
