No one appears for the State to oppose this application. Petitioners are seeking anticipatory bail in connection with Bathnaha P.S. Case No. 308 of 2018 registered for the offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners submits that the names of the petitioners have transpired in the confessional statement of the co-accused Manti Devi from whose house the alleged liquor has been recovered. Learned counsel submits that it is a case of false implication and there is nothing to connect
Patna High Court CR. MISC. No.13243 of 2019(2) dt.07-03-2019 2/2 them with the present case save and except the confessional statement of the co-accused.
In the given facts and circumstances of the case considering the submissions of the petitioners that their names have transpired in the confessional statement of the co-accused and the recovery is from the house of said co-accused and that the petitioners have nothing to do with the alleged liquor, in case of arrest or surrender of the petitioners within a period of four weeks from today, the abovenamed petitioners shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) each with two sureties of the like amount each to the satisfication of the learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Bathnaha P.S. Case No. 308 of 2018, subject to the condition that petitioners shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
