JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. 1362 of 2013 registered for the offences punishable under Sections 498A, 420 and 34 of the Indian Penal Code.

Petitioner no. 1 if mother-in-law whereas petitioner no. 2 is elder brother-in-law of the complainant. Admittedly, prior to filing of present Complaint Case the complainant had made complaint before Bihar State Women Commission, Patna and on the basis of Complaint of the petitioner

Patna High Court Cr.Misc. No.2858 of 2015 (2) dt.21-01-2015 2/2 Case No. 1365 of 2011 registered in the above stated Commission and the concerned Commission decided the dispute of the parties and before the Commission the complainant had stated that she had no complain against her in-laws which is evident from perusal of Annexure-2 to the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Sub - Divisional Judicial Magistrate, Bhagalpur in Complaint Case No. 1362 of 2013, subject to condition as laid down under Section 438(2) of the Cr.P.C.
