JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2017 The petitioner seeks regular bail in connection with Kursakanta P.S. Case No. 63 of 2017, registered for offences punishable under Sections 302/34 of the Indian Penal Code Allegation against the petitioner is of killing the deceased.
It has been submitted on behalf of the petitioner that petitioner's name has surfaced in this case only on the basis of suspicion as earlier the petitioner has threatened the deceased of dire consequences and except that there is nothing against the petitioner and he has clean antecedent and has been in judicial custody since 06.04.2017.
Heard learned A.P.P. also. He has opposed the prayer for bail.

No.30425 of 2017 (3) dt.24-07-2017 2/2 Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, at least, at this stage, his application for regular bail is, accordingly, rejected.
