JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 06-07-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Maner P.S. Case No. 384 of 2018 corresponding to Sessions Trial No.589 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioner has filed the present bail application and submitted that earlier on 25.07.2019, the bail application of the petitioner has been rejected by this Hon'ble Court with an observation that the trial court is directed to expedite the trial. The report has been annexed as AnnexureA. On perusal of the stated report stating that the discharge petition on behalf of the accused Jay Prakash Singh was filed which is fixed for order on 26.03.2020 and the trial is not in
Patna High Court CR. MISC. No.12971 of 2020(4) dt.06-07-2020 2/2 progress. There is no new ground to enlarge the petitioner on bail.
Learned A.P.P. for the State has opposed the prayer for bail.
In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner in connection with Maner P.S. Case No.384 of 2018 corresponding to Sessions Trial No.589 of 2019 is hereby rejected. However, if the trial is not concluded within nine months, then the petitioner may renew his prayer for bail.
