The petitioner is apprehending his arrest in connection with Kateya P.S. Case No.171 of 1996 for the offences instituted under Sections 304B, 201/34 and 120-B of the Indian Penal Code.
The prosecution case, in brief, is that the informant Ramashankar Mishra alleging therein that his daughter namely Mamta was married with Sanjeet Pandey on 1.5.2015 at the time of marriage he gifted several things and perform her Bidai but after some days her husband-Sanjeet Pandey and his family members started torturing her.
It is submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.11282 of 2016 (2) dt.02-05-2016 2/2 petitioner has got no criminal antecedent. He has falsely been implicated in the present case. There is no eye witness to the alleged occurrence. The deceased is said to have died during the pregnancy which she was going through.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R. and is the husband of the deceased.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Anyhow, if the petitioner surrenders in the court below, same shall be considered on its own merit without being prejudiced by this order.
