Petitioners apprehend their arrest in connection with Konch P. S. case no. 151/2014 registered under sections 307, 379 and other allied sections of the IPC and 27 of the Arms Act. Petitioners are named in the first information report and allegedly, petitioner no.2 gave garasa blow to the informant's son, namely, Roshan Kumar and so far as petitioner no.1 is concerned, it is alleged that he opened fire but admittedly, no one sustained any fire arm injury.
Learned counsel for the petitioners submits that there is case and counter case between the parties and persons from both sides sustained injury which is evident from perusal of annexure 2 and annexure 3 to this petition. It is further contended by him that so far as
Patna High Court Cr.Misc. No.3139 of 2015 (3) dt.04-02-2015 injured- Roshan Kumar is concerned, no fracture was found on his person which is evident from perusal of annexure 2 to this petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Konch P. S. case no. 151/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
