JUSTICE ARUN KUMAR ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Jagdishpur P.S. Case No.191 of 2016 registered under Sections 147/148/149/302 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is that the accused persons entered into the shop of the informant and started looting the shop thereafter Bajrangi Mandal shot at informant's husband and again this petitioner fired at him causing firearm injury on the temple. Submission is that only a few days back this petitioner has lodged a case against the informant's son and in that case he was undergoing treatment in the hospital. However, there is no such document to show that he
Patna High Court Cr.Misc. No.30727 of 2017 (2) dt.10-07-2017 2 / 2 was indoor patient and for that reason he has falsely been implicated in this case.
Considering the nature of the offence and specific allegation against the petitioner, prayer for anticipatory bail on behalf of the petitioner is rejected in connection with Jagdishpur P.S. Case No.191 of 2016, pending in the court of the learned Chief Judicial Magistrate, Bhagalpur.
However, if the petitioner surrenders and seeks regular bail, the same shall be considered on merit without being prejudiced by this order.
