JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 Petitioners seek bail in anticipation of their arrest in connection with Bounsi P.S. Case No. 05 of 2016 registered for the offences punishable under Sections 147, 148, 149, 323, 341, 447, 379, 354, 385, 504, 506 and 509 of the Indian Penal Code. Prosecution case as per FIR is that while informant was irrigating his field by electric motor one Ox felt electric shock and thereafter it is alleged that petitioners and others came and assaulted son of the informant by fists and slaps and when his daughter and others came to save him they snatched ear ring, nose pin and case of

Patna High Court CR. MISC. No.16269 of 2019(3) dt.02-05-2019 2/2 Rs.50,000/- and there is also allegation of outraging the modesty of daughter of the informant.

Submission of learned counsel for the petitioners is that allegation itself shows that occurrence took place as an Ox got electric shock and there was altercation between the parties and the other allegations are ornamental just to make the case serious. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Bounsi P.S.Case No. 5 of 2016, corresponding to G.R.No. 144 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
