JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within three weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Sections 366A, 376, 201 of the Indian Penal Code and Section 4 of the POCSO Act.

The petitioner was refused bail vide order dated 29.06.2020 passed in Cr. Misc. No.13362/2020, but had been given liberty to renew his prayer for bail after framing of charge.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.24802 of 2021(2) dt.28-07-2021 2/2 charge has already been framed on 11.01.2021 against the petitioner, which is mentioned in the impugned order. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Court below/successor Court; where the case is pending in connection with POCSO Case No. 42/2019 arising out of Barahiya P.S.
