JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Allegation against the petitioner is that he has hand in the illegal appointment of one Mukesh Kumar in collusion with the employment unit.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. The allegation made in the F.I.R. has been denied by the petitioner. Petitioner is the Mukhiya of the concerned Panchayat. The appointment of Panchayat Shiksha Mitra has been made as per the Regulation laid down under Resolution no. 1079 dated 20.6.2002. The other co-accused has been granted bail vide Cr. Misc. no. 2757 of 2016. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on

Patna High Court Cr.Misc. No.11072 of 2016 (2) dt.18-04-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Runni Saidpur P.S.
