JUSTICE BIRENDRA KUMAR ORAL ORDER 11-07-2017 Heard the learned counsel for the petitioner and the State.

This is a petition for grant of regular bail for offence under Sections 406, 420, 465, 466, 467, 468 and 120B of the Indian Penal Code.

Allegation against the petitioner is that through viamedia of other accused, money was transferred in the bank account of this petitioner to ensure back door entry in Government job.

Submission of the learned counsel for the petitioner is that the petitioner is in custody since 23.03.2017. There is no allegation that the petitioner had demanded money from the informant. More over, the informant had himself indulged in illegal activity of ensuring back door entry in Government job. Hence, the informant can not be protected under law. Considering the entire facts, aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Kotwali P.S. Case No.

Patna High Court Cr.Misc. No.29509 of 2017 (3) dt.11-07-2017 2/2 124 of 2017 to the satisfaction of the Chief Judicial Magistrate, Patna, or successor Court with the condition that the petitioner shall file undertaking at the time of furnishing bail bond that he would not indulge in such activity in future, failing which it should be a ground for cancellation of the bail bond of the petitioner by the Court below itself.
