JUSTICE PURNENDU SINGH ORAL ORDER 02-09-2025 Heard Mr. Saurav Barial, learned counsel appearing on behalf of the petitioner and Mr. Pradeep Narain Kumar, learned APP appearing on behalf of the State.

2. The petitioner apprehends her arrest in connection with Nardiganj P.S. Case No. 267 of 2024 registered under Sections 316(2), 316(5), 318(4), 3(5) of the BNS.

3. As per the allegation made in the FIR, the petitioner, along with other accused, has embezzled Rs. 1,57,8,424/- from the funds of Mukhyamantri Saat Nischay Yojana.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner, who was the Chairman of the Gram Panchayat, Nanaura, Ward No.10, has allegedly embezzled Rs. 1,57,8,424/- from the funds of Mukhyamantri Saat Nischay Yojana. Learned counsel further submitted that the

Patna High Court CR. MISC. No.14593 of 2025(4) dt.02-09-2025 2/2 petitioner seeks to deposit a fresh compounding fee in the account of the treasury, so that she cannot face the criminal prosecution in view of the offence being compoundable.

5. Learned APP for the State has no objection.

6. Considering the nature of crime and the same is compoundable, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of her arrest or surrender before the Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-II, Nawada in connection with Nardiganj P.S. Case No. 267 of 2024, subject to furnishing of the receipt showing payment of the compounding fee, which has been assessed by the authority having jurisdiction and other conditions, as laid down under Section 482(2) of the BNSS.

7. The bail application stands disposed of.
