====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 18-06-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Karanday P.S. Case No. 68 of 2024 dated 03.09.2024 registered for the offence punishable under Section 96 of B.N.S., 2023

3. As per the prosecution case, on 30.08.2024 at about 4.00 A.M., the petitioner is alleged to have kidnapped the daughter of the informant when she had went for call of nature.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the alleged occurrence took place on 30.08.2024 as to when the F.I.R. has been lodged on

Patna High Court CR. MISC. No.14079 of 2025(3) dt.18-06-2025 2/3 03.09.2024 and the delay in lodging of the F.I.R. has not been explained by the prosecution. It is submitted that the victim is a major girl aged about 18 years old as mentioned in the F.I.R. and she went from her house out of her own will due to behaviour of her parents. The petitioner has no concern with the alleged offence. The victim has been recovered and her statement under Section 183 of B.N.S.S., 2023 has been recorded in which she has stated that she of her own will went with the petitioner to Delhi and the victim was not forced to have sexual intercourse with any other person. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 09.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and has submitted that the petitioner is named in the F.I.R. and the petitioner had kidnapped the minor daughter of the informant.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-cum-Exclusive Special Judge,
