2. The petitioners are apprehending their arrest in connection with Parbatta P.S Case No. 16 and 2023 dated 22.01.2023 registered for the offence punishable u/s 147, 148, 149, 341, 323, 307, 379 and 509 of the Indian Penal Code.

3. As per the prosecution case, the informant's minor son namely Raghubansh Kumar and Raja Kumra @ Koila Kumar was asked or enquired about the stolen battery of Tempu by the accused after that the accused person started assaulting the children causing head injury to the Raghubansh Kumar and snatched one bhar gold chain from the Sunena Devi.

4. Learned counsel for the petitioners has submitted that the petitioners is innocent and have falsely been implicated in this case. There is a case and counter case between the parties. The allegation against the petitioners is general and omnibus in nature. The petitioners have no criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioners.

6. Considering the aforesaid facts and circumstances of the case, as well as the nature of allegation, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhagalpur in connection with Parbatta P.S Case No. 16 and 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. This application stands allowed.
