JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324 and 307/34 of the Indian Penal Code.

It is alleged that when the informant did not cast vote in favour of co-accused Md. Motin, then Rs. 25,000/- was demanded from the informant when on the order of Md. Motin, the petitioner assaulted with farsa on the head of the informant. It is submitted by learned counsel for the petitioner that there was no intention of the petitioner to kill the informant as there is no accusation of repeating the blow. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for

Patna High Court Cr.Misc. No.3430 of 2015 (2) dt.27-01-2015 2/2 consideration of regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Katra P.S. Case No. 179 of 2014 pending in the court of learned JM, 1st Class, Muzaffarpur. Accordingly, the application is disposed of.
