JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2018 Petitioner apprehends his arrest in connection with Riga P.S.Case No. 305 of 2017 registered under Sections 363, 442, 386 and 388/34 of the Indian Penal Code.

Allegation against the petitioner and other accused person, who happens to be S.I. of police, is that he forcibly apprehended the informant and demanded Rs.1 lac and threatened him to implicate a case if demand is not fulfilled. Submission of learned counsel for the petitioner is that no specific allegation is attributed against the petitioner, rather the main allegation against the S.I., who has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 23.2.2018 passed in Cr.Misc.No. 5800 of 2018. Heard learned APP also.

No.10760 of 2018 (2) dt.27-02-2018 2/2 Having heard both sides and in view of facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S.Case No. 305 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
