The petitioner has prayed for regular bail in a case instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 120B of the Indian Penal Code. The allegation against the petitioner along with others is of killing the father and brother of the informant. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. He has committed no offence. There is general and omnibus allegation against the petitioner rather the specific allegation is against co-accused Uday Das, who assaulted the informant's brother, due to which he succumbed to injury and in respect of death of informant's father it is
Patna High Court CR. MISC. No.14002 of 2023(3) dt.17-05-2023 2/3 submitted that postmortem report does not support the allegation of assault by seven persons by means of wielding knife but the postmortem report shows that the deceased sustained three knife injuries, one was found on neck and rest two on wrist and shoulder. He further submitted that the petitioner after hearing hulla went to P.O. to pacify the matter and snatched the knife from co-accused Uday Das and when the police came, petitioner handed over the knife, which has been termed as recovery by the police. There is no specific overt act against this petitioner. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 24.09.2022.
The application for bail is opposed by learned APP for the State, learned counsel for the informant and submitted that petitioner is named in the FIR and it is case of doubled murdered.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
