The petitioner seeks bail in connection with Didarganj P.S. Case No. 164 of 2017, Special Case No. 6868 of 2017 registered under Sections 30(a), 36 of Bihar Excise Amendment Act -2016.
90 liters of foreign made liquor is said to have been recovered from Indigo Car and petitioner was apprehended.
Patna High Court Cr.Misc. No.8287 of 2018 (2) dt.15-02-2018 2/2 It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner has no concern either with the aforesaid car or with the seized liquor. He was sitting in the car after taking lift and the owner of the car has been allowed bail by co-ordinate Bench of this Court in Cri. Misc. No. 62308 of 2017. Petitioner has no criminal antecedent. He has been languishing in custody since 10.10.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Didarganj P.S. Case No. 164 of 2017, Special Case No. 6868 of 2017.
