JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-08-2017 The petitioner seeks regular bail in connection with Jamui P.S. Case No. 266 of 2016, registered for offences punishable under Section 304B/34 of the Indian Penal Code. Petitioner is husband of the deceased and allegation against him is of causing dowry death of the deceased. It has been submitted on behalf of the petitioner that in fact the deceased committed suicide and villagers have also supported the case of defence. It has further been submitted that on the date of occurrence, deceased had called her brother to take her to her maike however, he scolded her and refused to take her to her maike which caused annoyance to the deceased and she committed suicide. Petitioner has been in judicial custody for last ten months.

Having heard both sides, in view of the fact that witness in the several paragraphs of case diary have stated about demand of dowry, which is mentioned in the impugned order, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of nine months.
