JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

The prosecution case is that the daughter of the informant Bibha Kumari aged about 15 years was abducted on 06.06.2015 while she was on morning walk.

It is submitted by learned counsel for the petitioner that the victim in her 164 Cr. P.C. statement, got her age recorded as 19 years when the court assessed her age as 17 years where she stated that she was never been abducted rather she went in the company of Ranjit Kumar of her own with whom she performed court marriage in Patna. Victim in her statement has not named

Patna High Court Cr.Misc. No.10838 of 2016 (2) dt.15-03-2016 2/2 this petitioner. The petitioner has been roped in the present case since he is the brother of Ranjit Kumar. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Mahua P.S. Case No. 384 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
