JUSTICE SANJAY PRIYA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kankarbagh P.S. Case 602 of 2015 instituted for the offence under Sections 394 and 120B of the Indian Penal Code.
It has been submitted that the petitioner is neither named in the written report nor any Test Identification Parade has been held. The name of this petitioner has been disclosed on the basis of footage of CCTV Camera. It has further been submitted that co-accused Jyotish Yadav with similar allegation has already been granted bail by this Court vide order dated 3.5.2017 passed in Cr. Misc. 19113 of 2017.
As per written report one Sandeep Kumar and Ajay Kumar (informant) were going by motorcycle to deposit money. On the way, one white colour Apache motorcycle came and the
Patna High Court Cr.Misc. No.32690 of 2017 (4) dt.02-08-2017 2/2 person sitting on the motorcycle snatched the bag and also fired causing fire arm injury to Sandeep Kumar. In this manner, the petitioner is not named in the written report. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna, in connection with Kankarbagh P.S. Case 602 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
