JUSTICE SANJAY PRIYA ORAL ORDER 04-04-2018 Heard learned counsel for the petitioner and the State. Prayer for bail of the petitioner was earlier rejected by this Court vide order dated 12.07.2017 passed in Cr. Misc. 27213 of 2017 with liberty to renew his prayer for bail after six months if trial is not concluded.
Report was called for from the court below regarding status of the trial, which has been received, wherein, it is mentioned that five non official witnesses have already been examined in this case, while important witnesses like Doctor and I.O. are yet to be examined. The learned court below has mentioned in its report that trial is likely to be concluded within a period of three months.
Learned counsel for the petitioner has submitted that petitioner is in custody since 16.08.2016.
In such circumstances, this application is disposed off with
Patna High Court Cr.Misc. No.11983 of 2018 (3) dt.04-04-2018 2/2 a direction to the court below to dispose of the case within a period of three months from the date of receipt of this order as mentioned in the report and send compliance report to this Court. The petitioner is given liberty to renew his prayer for bail in the court below itself in the event the trial is not concluded within aforesaid period which shall be disposed off by the court below in accordance with law. The trial court will give reason in the bail order for not concluding the trial within aforesaid period. (Sanjay Priya, J) S.Ali/- U T
