No one appears for the petitioner.
It appears that this application has been filed seeking modification of the order dated 05.10.2020 passed in the Cr. Misc. No. 48030 of 2019 by which this Court was pleased to grant anticipatory bail to the petitioner with a direction to surrender within a period of four weeks from the said date and to furnish the bail bond to the satisfaction of Smt. Sarika Vahalia, J.M. 1st Class, Patna.
On perusal of the application it appears that the
Patna High Court CR. MISC. No.15659 of 2022(2) dt.28-09-2022 2/2 petitioner could not surrender within the given time and has failed to furnish the bail bond as per the order of this Court within the stipulated period.
It is stated that because of the careless attitude of the Parivikar of the petitioner he could not surrender in the learned court below.
It is submitted that during the intervening period due to Covid 19 pandemic also the petitioner was unable to abide by the order of this Court.
In the given facts and circumstances of this case, this Court deems it just and proper to extend the period for surrender by another six weeks from today.
If the petitioner surrenders and furnishes the bail bond within six weeks from the today, he will get the privilege of prearrest bail in terms of the order dated 05.10.2020 passed under the Cr. Misc. No 48030 of 2019.
This application stands disposed of accordingly. Certified copy of this order shall be made available only after removal of the defects.
