JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Narhat P.S. Case No. 258 of 2018 dated 10.10.2018 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016. On secret information that the petitioner and others are selling liquor in an unauthorized manner, a raid was conducted. Five persons are said to have been arrested with approximately 10.5 litres of liquor. An attempt was also made to nab the petitioner but the petitioner somehow managed to escape from the place of seizure.

The learned counsel for the petitioner has submitted that but for some information to the police that

There is no recovery of liquor from the possession/constructive possession of the petitioner and he has clean antecedents. Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Nawada in connection with Narhat P.S. Case No. 258 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
