JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
Bolero vehicle of the informant was stolen.
Subsequently, it was recovered from the possession of Ramesh Gond and Dhurendra Sah who disclosed the name of the petitioner as one of the associates.
It is submitted by learned counsel for the petitioner that the petitioner is only chased on the basis of confession of co accused before the police. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.2812 of 2015 (2) dt.21-01-2015 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gopalganj in connection with Phulwaria P.S. Case No. 121 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate with the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in investigation by the petitioner will give liberty to prosecution to file application for cancellation of bail bonds by learned court below.
