JUSTICE SANDEEP KUMAR ORAL ORDER 25-04-2024 The following prayer has been made by the petitioner in this petition:- (i). For issuance of writ order/orders, writ/writs, direction/directions directing the respondent authorities to provide protection to the petitioner from miscreants disturbing the land by doing all kind of illegal activities and by threatening by the petitioner so as to grab the suit land forcibly which is in the possession of the petitioner.
(ii). For issuance of writ/writs, order/orders, direction/directions directing the respondent authorities to lodge FIR against private respondents vide respondent no. 9 & 24 under appropriate penal provisions.
2. It is an admitted position that title suit is pending between the parties.
3. Learned counsel for the petitioner may file an Injunction petition on behalf of the petitioner in the Title Suit which shall be considered by the Sub-Judge I, Patna City and decide the same within one month of its filing after hearing both the parties.

4. If the plaintiff do not cooperate in the disposal of the Injunction petition in the court below then the court below will pass an ex parte order.
5. Since the title suit is of the year 2010, Sub Judge-I, Patna City is directed to decide the suit within 13 months from the date of receipt/production of a copy of this order. The Sub Judge-I shall proceed ex parte against the noncooperating party including the plaintiffs if they do not cooperate in the disposal of the suit.
6. With the aforesaid observation and direction, this application is disposed of.
