JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354 and 379 of the Indian Penal Code.

It is alleged that the accused persons tried to throttle the son of the informant on 09.04.2013 and thereafter on 12.04.2013, the accused persons assaulted the complainant, her husband and children and snatched ornament, mobile and cash of `2,000/-. It is submitted by learned counsel for the petitioners that for the occurrence of 09.04.2013, the complaint was filed on 16.04.2013 when no injury report has been brought on record

Patna High Court Cr.Misc. No.3215 of 2015 (2) dt.23-01-2015 2/2 along with the complaint petition. Since the petitioners' side refused to marry with the daughter of the complainant, hence, the present compliant with false accusation has been filed. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the delayed lodging of the case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Purnea in connection with C.A. Case No. 990 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
