Petitioner along with one Md. Shamshad @ Raja were apprehended and on search, country made loaded pistols were recovered from possession of the each accused. Petitioner has got criminal antecedents and that happens to be the ground for distinction of his case whereunder his prayer for bail has been rejected by the learned lower court, even considering status of the co-accused having been released on bail by this Court at an earlier occasion on account of absence of criminal antecedents, however, is under custody since 15.09.2016.

Accordingly, petitioner, Md. Saddam is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 8th
