Petitioner apprehends his arrest in connection with Hajipur Sadar P. S. case no. 266/2014 registered under sections 494, 498A, 354/34 of the IPC and 3/ 4 of the D.P. Act.
Admittedly, marriage of the informant was solemnized with the petitioner on 02.06.2012 but she remained at her in laws' house for one month. Furthermore, first information report reveals that father-inlaw of the informant attempted to establish physical relation with her and also demanded motorcycle in dowry.
The contention on behalf of the petitioner is that informant herself does not want to lead her conjugal life with the petitioner and she was taken away by her father who executed a bond at the time of taking away the informant. Furthermore, it is pointed out on behalf of the petitioner that learned Sessions Judge attempted to patch up the dispute of the parties and for that purpose, he issued notice to the
Patna High Court Cr.Misc. No.3452 of 2015 (2) dt.27-01-2015 informant but she did not appear before learned Sessions Judge. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Sadar P. S. case no. 266/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
