JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in a case registered under Sections 395 and 397 of the Indian Penal Code. As per prosecution case, 8 to 10 miscreants armed with lathi danda and pistol intruded into the house of the informant and assaulted the informant and his family members and looted their cash and belongings.

It is submitted by the learned counsel for the petitioner that the petitioner is not named in the FIR. Nothing incriminating article has been recovered from the possession of the petitioner. The name of the petitioner has surfaced in the confessional statement of co-accused, namely, Akbar @ Akbar Alam. The said co-accused Akbar @ Akbar Alam has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 17.05.2017 in Cr.

Patna High Court Cr.Misc. No.31078 of 2017 (2) dt.06-07-2017 2/2 Misc. No. 21737 of 2017. The petitioner has no criminal antecedent. He has been languishing in custody since 04.11.2016. He was not put on T.I. parade.

Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kishanganj in connection with Kochadhaman P.S.Case No. 24 of 2016.
