Petitioner seeks bail in connection Runnisaidpur P.S. Case no. 95 of 2020 registered for the offence punishable under section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is in custody since 23.09.2020 and charge sheet has been submitted. It has further been submitted that from bare perusal of the allegation as alleged in the FIR, it would manifest that informant has alleged that he is working as Branch Manager in Bharat Financial Enclose Limited, Runnisaidpur and on 24.2.2020 he along with other staff were working as usual and some customers were also present there, in the meantime, three persons came in the office with arms and
Patna High Court CR. MISC. No.24208 of 2021(2) dt.17-11-2021 2/2 looted cash Rs 188960/-, 13 mobiles, biometric device, CCTV hard dish tab, some relevant papers and fled away after locking the door. Accused were masked and age group of 25-30 years. Learned counsel for the petitioner next submits that nothing has been recovered from the possession of the petitioner and petitioner has been remanded in this case from Bochahaon P.S. Case no. 65/2020 wherein his confessional statement was recorded and in his confessional statement petitioner confessed his guilt. He submits that confessional statement has no evidenciary value in the eye of law.
Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 23.09.2020 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Runnisaidpur P.S.
