The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The report of the learned trial Judge would reveal that six prosecution witnesses have already been examined and delay in framing of the charges was due to non-cooperation of the accused person. Petitioner is main assailant of the deceased. He is in custody since 30.11.2018.

Considering entire facts aforesaid, I am not inclined to enlarge the petitioner on bail in connection with Nayagaon P.S.

Patna High Court CR. MISC. No.24807 of 2021(3) dt.08-09-2021 2/2 Case No. 75 of 2005.

Hence, prayer is refused.
