JUSTICE PARTHA SARTHY ORAL ORDER 07-07-2020 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in connection with Bagaha (Patkhouli) P.S. Case no. 221 of 2019 registered under sections 147, 148, 188, 353, 506 and 149 of the Indian Penal Code.
As per allegation in the FIR, on receiving information that more than 100 persons had gathered with the dead body of one Angad Kumar Sahni, the informant with police personnel reached there. It is stated that they were raising slogan against the administration and were forcibly stopping other vehicles. It is further stated that amongst the miscreants, eight named accused persons including the petitioner herein were identified

It is submitted by learned counsel for the petitioner that although the petitioner is named in the FIR neither there is any specific allegation against the petitioner nor is there any allegation of damaging any government property. It is submitted that the case of the petitioner stands on a similar footing to that of several co-accused who have been enlarged on bail by order dated 13.9.2019 (Annexure 2) passed in Cr. Misc. no. 58067 of 2019. The petitioner has no criminal antecedent. The application for bail is opposed by learned counsel for the State.
Having heard learned counsel for the parties and in the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on anticipatory bail. The petitioner is directed to surrender in the Court below within a period of eight weeks from today and in the event of his arrest or surrender in connection with Bagaha (Patkhouli) P.S. Case no. 221 of 2019 he will be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Bagaha, West Champaran subject to the condition
