2. The petitioner seeks bail in a case registered for the offence punishable under Sections 103, 111(2), 111(3), 61(2) and 3(5) of the B.N.S. and Section 27 of the Arms Act.

As per prosecution case, on 21.12.2024, when the informant along with her husband had gone to attend a funeral, in the meantime, some unknown miscreants came and made indiscriminate firing due to which husband of informant died on the spot. It is further alleged that when one Vikash Kumar came to rescue, he was also shot dead.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R. Name of the petitioner

Patna High Court CR. MISC. No.13706 of 2026(3) dt.10-07-2026 2/3 surfaced in this case during investigation merely on the basis of confessional statement of co-accused Ankit and Rahul Sao @ Rahul Generator. Save and except confessional statement there is no material on record to show the complicity of this petitioner in the alleged offence. Moreover, charge-sheet has already been submitted and petitioner is in custody since 18.07.2025.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner and submitted that name of petitioner surfaced in this case during investigation in the confessional statement of co-accused Ankit Kumar Gupta and Rahul Sao @ Rahul Generator wherein they confessed that they, along with other co-accused persons, including this petitioner, were involved in the planning and murder of Dahi Gop and this petitioner, along with co-accused Rahul Generator, committed murder of Dahi Gop by shooting him. Petitioner has got three criminal antecedents.

6. Considering the facts and circumstances of the case, nature of accusation, materials that have surfaced during investigation and criminal antecedents of the petitioner, the prayer for grant of bail to the petitioner is rejected.

7. However, considering the fact that petitioner is in custody since 18.07.2025, the learned trial court is directed to
