2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302 and 302 and 34 of the Indian Penal Code .

3. As per the prosecution case , informant suspects that all the F.I.R., named accused persons including this petitioner killed the younger son of the informant.

4. Learned counsel for the petitioner submits that the informant is not an eye-witness to the alleged occurrence and only on suspicion he has been made accused in this case . As per F.I.R., deceased has some dispute with the son of the petitioner and this petitioner was not present at the time of occurrence . In

Patna High Court CR. MISC. No.18054 of 2024(5) dt.04-07-2024 2/2 fact petitioner was at Delhi, and this fact has come during investigation and in CDR of the petitioner. Except suspicion , there is no other material available on record to show the complicity of the petitioner in the alleged occurrence . Petitioner claims clean antecedent.

5. Learned counsel for the State as well as informant opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - IV, Darbhanga in connection with Singhwara P.S. case No. 169 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
