JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Kudhani (Turki O.P.) P.S. Case No. 767 of 2019, registered for the offences punishable under Sections 188, 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act 2016.

As per allegation, 108 liters of liquor was recovered from hut of the petitioner.

The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and is under custody since 14.01.2023.

Considering the above-mentioned facts and

No.13618 of 2023(2) dt.17-05-2023 2/2 circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. II, Muzaffarpur in connection with Kudhani (Turki O.P.) P.S. Case No. 767 of 2019, subject to the following conditions:- (i)Before release of the petitioner, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in any other case except the present one, the learned court below shall not accept his bail bond.
