The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 452, 354(b), 504 of the Indian Penal Code.

The prosecution allegation, in short, is that the accused person entered into the house of the informant and tried to outrage her modesty.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.9.2019. There is no

Patna High Court CR. MISC. No.15899 of 2020(4) dt.10-09-2020 2/2 allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner happens to be neighbour of the victim. Due to previous enmity, the petitioner has been falsely implicated in the present case. The allegation made in the F.I.R. is denied by the petitioner. There is no substantive evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -XIII, Gaya in connection with Atri Gaya P.S. Case No. 410 of 2019.
