JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-04-2018 Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 31.8.2017 passed in Cr. Msic. No.37026 of 2017.
Submission of the learned counsel for the petitioner is that the victim has been examined and she has not supported the prosecution case in her cross examination and the petitioner is in custody since 24.6.2017.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, as it is reported that four witnesses have been examined in this case and the case is pending for examination of the remaining witnesses, the learned trial court is
Patna High Court Cr.Misc. No.20862 of 2018 (3) dt.19-04-2018 2/2 directed to expedite the trial and try to conclude it within a period of six months, if possible to conduct it on regular basis. At the same time, the S.P., East Champaran is directed to ensure present of the witnesses so that the trial may be concluded within the period as specified.
With the aforesaid observation, this application is dismissed.
