The petitioner seeks bail in connection with Karjain P.S. Case No.125 of 2024 registered for the offence under sections 329(3), 76, 115(2), 351(2), 351(3), 303(2) of the B.N.S. 2023.

In the F.I.R., allegation has been levelled against the petitioner that he tried to commit rape with the victim but in the statement recorded under section 183 of the B.N.N.S, the victim has improved her statement and said that the petitioner has committed rape with the victim. The F.I.R. was registered on 21.08.2024 and the statement of the victim was recorded on 21.09.2024. The victim had got enough time to
Patna High Court CR. MISC. No.13897 of 2025(3) dt.09-05-2025 2/2 improve her statement. The petitioner is in custody since 16.12.2024.

Considering the aforesaid facts, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Birpur, Supaul, /concerned Court below, in connection with Karjain P.S. Case No.125 of 2024, subject to the condition that he will cooperate in the trial and will appear himself or through his lawyer on each and every date fixed in the trial.
