JUSTICE ARUN KUMAR ORAL ORDER 22-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Singhwara PS Case No. 140 of 2017 registered under Sections 302 and 201 of the IPC.
Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, only on suspicion he has been made accused, the deceased was second wife of his maternal-grand-father, informant (deceased's brother) only says that the deceased was seen going along with the petitioner by co-villagers but their statement is not recorded in the case diary and the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Chandra Prakash Tiwari @ Bittu Tiwari is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IV Darbhanga in connection with Singhwara PS Case No. 140 of 2017.
