The petitioners seek modification of the order dated 01.09.2017 passed by a Bench of this Court in Criminal Miscellaneous No. 39712 of 2017. By the aforesaid order, the petitioners were directed to be enlarged on bail in the event of their arrest or surrender before the Court below within a period of six weeks from the date of passing of the order.

However for the reasons which have been explained in the petition, the petitioners could not surrender

Patna High Court CR. MISC. No.14422 of 2020(2) dt.02-07-2020 2/2 within the period mentioned in the order dated 01.09.2017. The order dated 01.09.2017 is modified to the extent that in case the petitioners surrender before the court below within a period of six weeks from today, they will be accorded the privilege under the order dated 01.09.2017 with the same terms and conditions.

The order stands modified to the extent indicated above.

The modification application stands disposed of accordingly.
