The petitioner is languishing in custody for the offence punishable under Sections 420, 467, 468, 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Petitioner is owner of the pickup van and was arrested at the spot at the time of recovery of liquor from that van. Petitioner has got no criminal antecedent.

Submission is that some other persons were arrested at the spot who have already been allowed bail. Petitioner is in custody since 18.11.2019 and is ready to cooperate with the trial. Investigation of the case is already complete. Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.12173 of 2020(2) dt.29-02-2020 2/2 above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sakra P.S. Case No. 536 of 2019 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
