Vide impugned order dated 22.11.2017, the amendment petition filed on behalf of defendant has been allowed.

It appears from the impugned order itself that the defendant had sought for an amendment in his written statement in order to correct the area of the disputed land in Schedule 'A'. The application was filed at belated stage, as such, it was allowed at the cost of Rs.1000/-.

The learned counsel for the petitioner has submitted that the amendment petition was allowed by the Court below after settlement of the issues and after examination of one

Patna High Court C.Misc. No.496 of 2020(2) dt.16-11-2021 2/2 witness, but the order shows itself that the learned Court below has already imposed cost of Rs.1000/- on the defendant for his delayed amendment petition.

In my view, the impugned order need not be interfered with.

With these observations, this Civil Misc. application is disposed of.
