JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kotwali P.S.Case No. 525 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 Allegation in brief is that near a hillock around 480 bottles containing country made liquor as well as foreign liquor were found kept secretly and the petitioner was apprehended by the police.

Submission is that recovery is made from a public place and petitioner was apprehended merely on the basis of suspicion and he has clean antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, tutu Kumar @ Rohit is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with

Patna High Court Cr.Misc. No.2669 of 2018 (2) dt.30-01-2018 2/2 two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Kotwali P.S.Case No. 525 of 2017..
